This article deals with the legal regulation, procedures, and deadlines for receiving an inheritance in Georgia, with a special emphasis on the institution of receiving an inheritance through actual possession and management. The relevance of the research is due to the practical inefficiency of the current regulation, which is especially evident in the application of the six-month period and the process of confirming actual possession. The research is based on normative-legal, dogmatic-legal, and comparative-legal methods. Additionally, an analysis of judicial and notarial practice has been used, which allows for an assessment of the actual functioning of the current regulations in practice. The study found that the six-month period, in some cases, fails to ensure the effective realization of heirs' rights, which increases the risk of loss of rights and litigation. It has also been revealed that confirming the receipt of actual possession and management of an estate in practice is often associated with difficulties of proof and requires judicial intervention. These circumstances increase time and financial costs. Comparative legal analysis has shown that in a number of legal systems, the expanded powers of the notary simplify the process of receiving inheritance and reduce the need for judicial intervention. Accordingly, it is advisable to review the legal regulation of the deadlines for receiving an inheritance and the institution of receiving it through actual possession and management in Georgia, harmonize them with practice, and increase procedural flexibility, which will ensure more effective protection of the rights of heirs.
