Author : Nikoloz Pkhaladze 23/07/2026
The present article examines the legal regime governing compensation for property damage in claims brought against the National Agency of Public Registry of Georgia. The study aims to analyze the prerequisites, scope, and legal mechanisms of liability of state registration authorities, both from a normative and judicial practice perspective. The article considers the types of property damage arising from registration errors, the unlawful cancellation of rights, or the invalidation of transactions, and explores the legal grounds for their compensation. Applying a comparative legal method, the paper critically examines the extent to which Georgian substantive and procedural law effectively protects individuals' proprietary interests in cases of fault-based acts or omissions by the public registry. The research draws upon the Civil Code of Georgia, administrative law norms, and relevant judicial decisions. The article concludes that significant legal gaps exist, which may require further legislative refinement.
